The Social Security Administration has two programs under which it pays disability benefits: The Social Security Disability Insurance (SSDI) program and the Supplemental Security Income (SSI) program. In order to qualify, you must prove that you are unable to do any work for which you are suited by age, experience and education for at least a year, or that your disability will result in death.

Social Security will consider the following in determining whether you are eligible for benefits:

  • Whether you are working
  • Whether your medical impairment is of sufficient duration
  • Whether your impairment or illness is one listed in its regulations
  • Whether you are able to perform the type of work you have done in the past
  • Whether there is any lighter work available in the national economy which you could perform

SSDI benefits are paid based on prior work for which you paid Social Security taxes. Eligibility for SSDI is based on financial need and may be available to children as well as adults.

Compiling all the records and information needed for a Social Security disability case is a time-consuming process and one that requires a detailed knowledge of the system. Robbins & Associates Social Security Disability attorneys have amassed years of experience in appealing these cases to Administrative Law Judges. In many cases, we have been able to reverse the original ruling so that our clients were able to collect the benefits to which they were entitled.
